QUESTION:

It seems like South Korea has very stringent termination laws. Is notice always required for termination in Korea?

REPLY:

No. In Korea, notice is not required for termination under the following circumstances:

  • The employee is in a probationary period for less than three months
  • The employee has worked on a daily wage basis for less than three months consecutively
  • The employee has worked on a fixed-term basis for no more than two months
  • The employee has worked on monthly-salary basis for less than six months
  • The employee has done seasonal work on a fixed-term basis for no more than six months
